[screams] >> jon: disaster at the air show. i'm jon scott in for shepard smith. and the iranian president mahmoud ahmadinejad now repeating his controversial comment about 9/11 possibly being an inside job. he made the remarks during a speech at the united nations yesterday. president obama responded in a television interview calling ahmadinejad's comments offensive and hateful. but that didn't stop ahmadinejad from repeating himself at a news conference this morning. >> almost in all the polls over 80% of the american people consider the 9/11 tragedy a

suspicious one. >> jon: we have no idea what polls he is referring to there we wanted to grill him about this ourselves. you will remember yesterday we told you shepard was scheduled to interview president ahmadinejad. after the interview was confirmed the iranians called it off citing some sort of, quote, bilateral problems and chaos at their hotel. this morning they changed their minds again, but shepard was no longer available, having since left on a trip that he had initially cancelled for the interview and then rebooked. so our senior correspondent eric shawn stepped in to sit down with ahmadinejad. and he joins us now. eric? >> well, jon, he accused me of trying to order him about what to say. he claimed i was representing the united states government and the united nations security council and that i am backed by the defense department. i assured him i'm an objective reporter asking questions and some he clearly did not like. well, he did wish the american people, quote, the good people of america a happy time. he defended those controversial remarks about 9/11 that have

angered so many. >> you wished americans well, but you have insulted millions and millions of americans by claiming that the u.s. government had a hand in 9/11. quite frankly, sir, how could you say such an insane and nutty thing? >> would you address your own president the same way? would they ever allow you to? >> in terms of that remark, sir, in terms of those remarks. >> you probably didn't read the full remark. >> yesterday. what evidence do you have that the u.s. government is responsible for 9/11? well, you are smiling. do you believe the government had a hand in 9/11? >> i did not say -- give an opinion of my own. i actually suggested that a fact-finding group and mission be formed to delve into the truth. do you think that the entire

world has to accept what the u.s. government tells them? >> osama bin laden has taken credit. al qaeda officials have taken credit. it seems very clear. >> that's fine, but the fact finding mission can shed light on who the perpetrators were. >> would you swear to allah that you are not planning to build a nuclear bomb? >> do i have to swear? >> well, you have to say your view. >> you are telling me that i have to? you have to determine what i have to say? >> well, do you? >> who says have to? what kind of language is there a law that says i have to? >> do you want to pursue a nuclear bomb? >> i have said on numerous occasions that we do not want an atomic bomb. >> why should we believe you? you are violating four u.n. resolutions. you have kicked out u.n.

inspectors. why should the world believe anything that you say on this subject? >> we do not insist that you should believe us. we have never said that you should. you are free not to believe us, but why would you insist on imposing your view on us with resolutions? with force? >> would you meet with benjamin netanyahu? >> why should i meet with him? are you ordering me to? not. it seems like you are ordering me to. >> what would you say to him? >> why should i meet with him? no, i will not meet with him. >> why not? >> of course, my message is that they should return to their own home. they should stop killing people and stop waging war. and not engage in terror and not build atomic bombs.

>> jon: round and round and round he went. i know you also asked him about terrorists that target americans. right? what did he say. >> i talked with terrorism with him and exactly his view on that and will iran stop supporting terrorism and he denied that iran supports terrorism. he says that iranians are the victims of terrorists. on that fact, he sent a second letter to president obama. he told me that he is waiting for a response that terrorists are infiltrating iran. he says from afghanistan and pakistan but has not yet received a reply from the president. he called the occupation of afghanistan and iraq he says has not stopped terrorism, jon, but has only increased terrorism around the world. >> jon: i know that they have thousands of human rights activists locked up, basically rotting away in iranian prisons. did you ask him about that. >> i asked him would they stop killing protesters who protest for democracy in iran? he said basically their view of it is if you are clashing with police and attacking police, you are not protesting for democracy. he says that he is a democratically elected

president. that he has gotten more than two and a half more votes than american presidents have. of course, did he not address any allegations or mention allegations that that election has been so tainted. >> jon: and he thinks you are part of the u.s. government? >> not only that the u.n. security council. so i got both and the defense department. i think it was a pretty feisty and spirited interview. he may not have been accustomed to that. in a news conference after that interview he said i talked to a american reporter yesterday he is connected to a government institution that, of course, is not true. i said i'm an objective reporter. he ended that conference by saying i want to ask american politicians to stop using the media as a tool. >> jon: wow. interesting day. eric, thank you. >> thank you, jon. >> jon: fox news has learned the iranian president also met with the american hiker recently released from a prison in tehran. the meeting was reportedly brief and pleasant. that hiker sarah shourd says ahmadinejad was very gracious. she says he was happy to meet her mother and asked her mother

questions about the family. they talked about her fiance still in prison in iran. and sarah shourd called ahmadinejad, quote, very positive and said it was, quote, a very human encounter, at the the -- very personal. sarah shourd said she wanted to meet with mahmoud ahmadinejad to encourage the release of her fiance and their friend still in prison. iran accuses them of spying. >> we were just innocent victims of an unfortunate situation and my fiance and friend are still suffering. >> she says the three were vacationing in a tourist spot in northern iraq when iranian soldiers arrested them near the border. >> we asked where a good trail was, and we followed the trail the next morning for about three hours. and it was just, you know, well-made trail with absolutely -- we didn't see another human being hiking or any human beings around. or any indication that we were

near the border. you know, there was no flag or fence or any indication, no signs when we stumbled on to some soldiers. >> were they just there along the trail? were they just sitting there? was there some sort of outpost or something? >> nothing, no. we didn't see anything. we just saw soldiers in the distance. >> shourd spent 410 days in solitary confinement. iran released her recently on $500,000 bail after reports that she may be ill. a fox weather alert now. we are keeping an eye on severe flooding in the plain states and the great lakes region. take a look from the area. a news crew was there earlier today. some terrible flooding south of minneapolis. we have had some pictures. cars floating around, buildings. all kinds of mayhem a small storm wrecked a small town in south dakota yesterday. hundreds of people had to leave

pretty tight and so did the federal judge. jon? >> jon: jennifer griffin, thanks. a mexico san journalist says he has escaped his country's deadly drug war with asylum in the united states. the editor of the news web site covers the attack on mexican drug gangs as well as other stories. he says someone started threatening him two years ago. the asylum ruling would be a first for a mexico call journalist since the drug war began. meanwhile, violence in mexico has claimed two more high profile victims. both of them politicians in northern mexico. police say a gunman murdered a mayor and one of his employees at his home near monterrey late yesterday. today, shooters seriously wounded a mayor elect small town of sue ciudad juarez. there was a break-in, a robbery, a hostage stand off and arson. not to mexico the torture, --

experts about what happened during a home invasion in 2007. two men are accused of murder and rape among other charges in this horrible case. the trial is for one of the suspects, steven hayes, seen here. much of the testimony in his trial is so disturbing we have

chosen not to report all of the details here. prosecutor say the two men are responsible for a night of rape and murder that left a mother and her two daughters dead and the girl's father barely alive. laura ingle was inside the courtroom in new haven, connecticut, today. the court heard from forensic experts, i know. tell us what they said. >> good evening, those experts were able to talk about how they tested the d.n.a. samples taken from the victims. we're talking about blood, saliva, and see men and match them directly to the suspects in this case. prosecutors allege that steven hayes sexually assaulted the mother jennifer hawk pettit before strangling her with his hands. joshua majewski who is expected to face trial next year is accused assaulting 11-year-old pettit before helping hayes light the house on fire. all three were killed in this attack. jurors heard from a fire marshal today that testified that an

accelerant like gasoline was poured directly on to the pettit daughters as they lied tied up in their bed that was testimony that sent family members out of the courthouse in tears today, jon? >> jon: what about what happened outside the courtroom? tell us about that. >> yeah there was certainly high emotions happening right out here on the courthouse steps. the lawyer for joshua majewski made a surprise statement today in the courthouse outside the courthouse to clear up what he called a misconception about his client. remember, everybody is under a gag order in this case. this lawyer jeremiah donovan said that his client did not sexually assault mckayla pettit, despite the evidence, which he said he hoped would provide some small solace for the family. >> we don't need his sympathy. we don't want his sympathy. he had threatened to hold press conferences on the courthouse steps and was told by judge that he was not to break the gag

order. yet, he chose to do that today. >> the sole survivor the attack dr. william pettit says he hopes the judge will cite that lawyer for contempt of court and the family left visibly shaken. here today court resumes next week. jon? >> jon: laura ingle, thanks. california is a step closer to carrying out the death penalty for the first time in four years. a federal judge saying executions can continue. now that the state has changed its procedures. the same judge put lethal injections on hold in 2006 amid concerns the process was cruel and unusual punishment. since then, the state has built a new death chamber and updated its regulations. convicted killer and rapist albert brown set to be put to death there next week but he can still appeal to federal and county courts. just over three months until the bush tax cuts are set to expire but some democrats want to wait until after election day to vote on whether to extend them. critics calling that gutless and

>> jon: actress lindsay lohan back in orange and back in jail as fox reports tonight. according to the web site tmz her attorney has met with the judge to okay out some kind of release. lindsey's lawyer appealed the judge fox's ruling that she should be held without bail. the judge must grant bail and asking the california court of appeals to his hearing. possession of cocaine. the drug is expected to pay it and go home. that is not what happened. instead, the judge ordered her to jail, no bail. lohan left the hearing in handcuffs. and we got another mug to add to our collection. here are some of her booking photos from her original drunk driving arrests. to her more recent troubles. with more on what happened today, here is alizener from fox 11, los angeles. >> lindsay lohan arrived here, jon, about 10:00 west coast time this morning.

this is the jail in california. a women's jail. she immediately was booked and then went through a process that involves medical and psychological testing. she was supposed to be in court about 8:30 this morning. she was actually about 15 minutes early. then in the courtroom she was almost immediately remanded into custody. without delay she was taken to the beverly hills courthouse to this women's jail which has housed inmates like paris hilton, nicole richie and lindsay lohan who has been here twice before. the longest for 14 days early summer. released both times because of jail overcrowding. that's not likely to be held this time because she something held until her probation hearing next month. because she has been here before, she came here knowing the drill which includes being put in a private cell away from the general population, as not to disrupt what's going on in the jail facility. in linwood, california, i'm hal eyesner back to you. >> i'm jon scott in for shepard

smith. this is the fox report. it's the bottom of the hour, time for the top of the news. congress will extend the bush tax cuts for the middle class that's the promise today from house speaker nancy pelosi. she should the vote could happen before lawmakers head home to campaign. >> there isn't a person in our caucus that isn't for tax cuts for the middle class. it's not about the elections. it's about the policy and we're all very strong on that and members with a vote or without a vote can go home and talk about their commitment to that. >> jon: the tax cuts expire at the end of the year. just yesterday, senate democrats put off their vote until after election day. white house correspondent mike emanuel live here in new york. i guess democrats and republicans are battling over the tax cuts for the richest americans, right? >> jon, the most drama is on the democratic side. you have the leaders who don't want to extend it for individuals making more than $200,000 a year or families making more than 250,000 adds year. you have got democrats who are in tough races who think maybe

tax cuts should not be raised during a difficult economic recovery or, perhaps, you know, people from wealthy districts who don't want to raise taxes at this point, you know, less than six weeks from election day. that's where the drama is, jon. >> jon: and the thinking is that some of these lawmakers might vote differently in a lame duck session, right? >> that's right. we got some interesting reaction from a republican senator today who commented on because the republicans want to extend all the tax cuts for everybody. here is what he had to say. >> it was a gutless approach to this. look, i understand the democrats. they know this is going to be a tough election for them. and, frankly, they have never really had the guts to do what they really believed unless and they have overwhelming numbers. >> senator happen calling it gutless. but bottom line when they think the lame duck session comes back when their necks or not on the line they will be extended at least for a year and kicking the can down the road if you will, jon. >> jon: mike emanuel, thank you. >> thank you.

>> jon: the former chairman of the federal reserve says the financial system is still broker. paul vehicle kerr delivering -- volcker delivering asexment and changes in the off the cuff speech in chicago. peter barnes joins us. he criticized a number of the parts of the financial system, huh? >> that's right, jon. he threw out his prepared remarks and went on a tear. he trashed the banks and their ceos. he is worried that all of these new rules from washington will not work. and in an interview with fox business, he told regulators to get some backbone. >> i think this is going to take a lot of attention because there is a lot of pressure, as you know, from the industry, from the lobbyists, let us do what we want to do. >> he also warned that regulators can be pressured by politicians, too jon. >> jon: but we got some good news today, peter, which sent stocks on a rally.

>> that's right. first some good economic news out of germany and then from the u.s., and that helped to take the dow up nearly 200 points today about a 2% pop along with all the other indexes. the dow is now on track to close out its best september in 71 years. >> jon: peter are barnes, fox business. thank you. along with stocks, the price of gold has been rising. hitting another record today. above $1,300 an ounce. it settled just below that milestone. investors have been stocking up on the precious medal as a hedge against inflation. for the first time since the peek of the financial crisis the ceo of citigroup will earn more than a buck next year. in a statement the company reports its board of directors will raise vikran pan diddit's salary. he announced last year he would earn a dollar a year until the bank returned to profitability.

they had trouble undocking the capsule from the station. crew members performed some fixes and nasa reports everything seems to be working correctly now. so if things go smoothly, the team should be able to undock within a few hours and return to earth tomorrow. still, problems like this are of greater concern these days because with the space shuttles going out of service next year, the agency will have to rely on the russian space craft. they robbed a bank without ever stepping inside. at last check they got away with it now police and the fbi on the hunt for some bandits with a knack for booby traps. details coming up. but first we learned today of the death of 50s icon eddie fisher. a singer just as well known for marriages to some of hollywood's biggest stars. he was born in philadelphia and sold millions of records, including "thinking of you" and "lady of spain." in 1955 he married actress debbie reynolds. the follow year the couple gave

a state board of education remember reviewed it and found islam was mentioned 27 times in the table of contents while christianity was only referenced once. the former west texas school board president who helped draft today's resolution says the board's vote sends a strong message to textbook publishers. >> there is nothing too offensive about it. as far as i can see we just want to make sure what my view is that judaism and christianity are presented with the proper roles that they have in world history and it's just gigantic. but in the books, you have to search for it. >> critics were calling on the texas state board of education to reject the resolution because they say it does nothing more than politicize education and exploit anti-muslim bigotry. >> to put forward a resolution that we know would affect publishers in the way they present their material is kind of like saying watch out, there is some arab guys funding these things. it's kind of just ridiculous. it's asking people to put together a spider's web that doesn't exist.
